Consumer Credit File Rights Under State and Federal Law
Required disclosure under 15 U.S.C. §1679c — Credit Repair Organizations Act
This disclosure is provided to you pursuant to the Credit Repair Organizations Act (15 U.S.C. §1679 et seq.) by IPA LLC, operating as Dispute2Go ("Company"). You have the right to receive this disclosure before entering into any contract for credit repair services.
Your Rights Under Federal Law
1. Free Right to Dispute. You have a right to dispute inaccurate information in your credit report by contacting the credit bureau directly. There is no fee for this. You may dispute items with each of the three major credit reporting agencies — Equifax, Experian, and TransUnion — at no charge, without the assistance of a credit repair organization or any third party.
2. Outdated and Unverifiable Information. An adverse item of information in your credit report generally may not be reported if it is outdated. Most negative information (other than bankruptcies, which may remain for up to 10 years) must be removed after 7 years. In addition, if a credit bureau cannot verify the accuracy of an item you dispute, that item must be removed from your credit file.
3. Bureau Reinvestigation Obligation. If you notify a credit bureau in writing that you dispute the accuracy of information in your credit file, the bureau must reinvestigate within 30 days of receiving your dispute (with limited exceptions for frivolous disputes). During reinvestigation, the bureau must review the disputed information and record the current status of the item, or delete the item if it cannot be verified.
4. Right to Add a Statement. You have a right to add a brief statement to your credit file if you disagree with the outcome of a reinvestigation. The statement will explain your position regarding any disputed item, and it will be included or summarized in any future consumer report containing the disputed information.
5. Right to See Your File. You have a right to know what is in your credit file. You are entitled to one free credit report per year from each of the three major bureaus through annualcreditreport.com. You also have the right to request your file at any time and to know who has accessed your credit information.
6. No Guarantee of Results. Dispute2Go (IPA LLC) cannot guarantee the removal of any item from your credit report. Credit bureaus make the final determination as to whether an item is deleted, updated, or verified. A credit repair organization cannot lawfully promise specific point increases, guarantee a particular credit score, or guarantee specific outcomes from a dispute.
7. Right to Cancel. You may cancel any contract with a credit repair organization within 3 business days of signing the contract, without penalty or obligation. The right of cancellation begins on the date you sign the contract. To cancel, you must deliver a written notice to the credit repair organization (by mail, fax, or other means) before midnight of the third business day after signing.
8. No Advance Fees. Under CROA §1679b, credit repair organizations are prohibited from charging or receiving any money or other valuable consideration for the performance of any service before such service is fully performed. You should not be charged before the credit repair services have been completely delivered.
CROA Contract Requirements
Under 15 U.S.C. §1679d, any contract for credit repair services between you and a credit repair organization must be in writing and must include:
(a) The total amount of all payments to be made by the consumer to the credit repair organization.
(b) A full and detailed description of the services to be performed, including all guarantees of performance and an estimate of the date by which the services will be performed or the length of time it will take to complete them.
(c) The credit repair organization's name and principal business address.
(d) A conspicuous statement in bold face type, in immediate proximity to the space reserved for the consumer's signature, which reads as follows: "You may cancel this contract without penalty or obligation at any time before midnight of the 3rd business day after the date on which you signed the contract. See the attached notice of cancellation form for an explanation of this right."
(e) A completed form in duplicate, captioned "Notice of Cancellation," which the consumer may use to cancel the contract.
Prohibited Practices Under CROA
Under 15 U.S.C. §1679a and §1679b, a credit repair organization may not:
• Make any statement, or counsel or advise any consumer to make any statement, which is untrue or misleading with respect to any consumer's creditworthiness to any person who has extended credit to the consumer or to any person to whom the consumer is applying for credit.
• Make any statement, or counsel or advise any consumer to make any statement, the effect of which is to alter the consumer's identification for the purpose of concealing adverse information in the consumer's credit record.
• Make or use any untrue or misleading representation of the services of the credit repair organization.
• Engage, directly or indirectly, in any act, practice, or course of business that operates or would operate as a fraud or deception upon any person in connection with the offer or sale of services.
